Who provides indemnity for UMAPs members?

Our preferred partner for indemnity is MDS.

Traditionally, professional defence and employment matters have been handled by completely separate organisations and representatives. However, it is often impossible to separate these in real life. A clinical incident could lead to not only an internal investigation involving MHPS, but also lead to a GMC referral, a malpractice claim and even interest from the Police.

MDS is the only organisation that can deal with employment, regulatory and malpractice claims related to NHS employment all by itself.

Their multi-disciplinary team deals with complex matters in a seamless manner, thus avoiding a member from bouncing between organisations and advisors.

MDS also has its own in-house solicitors team which means that their advisors can have unbiased and direct access to expert legal advice.

This means they can focus on our member’s needs holistically and provide personalised professional support, without compromise.

Why is Crown Indemnity not enough to cover my work?
Crown indemnity covers only the payout once a professional has been found to be negligent and caused harm to patient. It does not cover you for any costs accrued in assembling and defending a claim against you. This means that you arent supplied with a barrister or solicitor to counsel you through the process.

Importantly a claim will often start off as an employment matter that then spreads to GMC and potentially criminal proceedings. CNSGP/T leaves you to cope with the entirety of these processes alone until you reach the stage of payout. This is not something we recommend.

I’m already with a different indemnity provider. Do I still need the UMAPs x MDS cover?

Whilst other organisations cover you specifically for medical indemnity, they do not cover you for employment disputes. This is where our basic membership covers you for both trade union membership and to provide expert employment law advice in the early stage of an event.

Can I get representation at work?
At the present time, a good litmus test for if your employer is being reasonable is whether they engage with us at the early stages of your grievance. Whilst there is no legal requirement, the outcomes for those that do are infinitely better than those that don’t.
What happens if I take indemnity out after the event took place?
Currently, we will review your case and provide a fixed fee if we think the case is able to be taken forward. This will be significantly cheaper than private sector legal work but still exponentially more expensive than if you had set up indemnity in advance. Therefore, in the current climate, we recommend all MAPs get indemnity at their earliest conveniance.
